Meeting the New Compliance challenge in Export Contol
New U.S. and China export controls are creating a compliance vice for companies, demanding greater supply chain scrutiny. The U.S. requires identifying 50%-plus subsidiaries of restricted firms, and China has introduced a similar rule, plus stringent, extraterritorial controls on rare earths and related technologies. Though paused for one year as part of a trade truce, these rivalry-driven regulations add significant complexity for multinationals.

The life of Dr. Chen Xin perfectly embodied the precision of science and engineering, the acuity of law, and the warmth of the humanities. He was the most unique face in Taiwan's high-tech industry.
Dr. Chen's family legacy is in itself an epic that spans academia and practice: his father, Chen Zhimai, was a diplomat active on the international stage; his mother, Li Xianchu, held a Bachelor's degree in Foreign Languages from Tsinghua University in Beiping; and his maternal grandfather, Li Jinxi, was a linguist who promoted the modernization of the Chinese language. Even further back, his great-great-grandfather, Chen Li (Master Dongshu), was a Confucian scholar of the Qing Dynasty who mastered classic texts and was also a renowned mathematician with deep studies in geometry and arithmetic.
A passion for precise science and a deep appreciation for cultural heritage seem to transcend a century, resonating in Dr. Chen Xin with a modern echo. He comes from the highest academic halls, holding a Ph.D. in Physics from the University of Michigan, postdoctoral research in Electrical Engineering at Stanford University, and a Juris Doctor (JD) from UC Berkeley. Such a rare interdisciplinary combination at the time endowed him with a penetrating perspective: he could understand the physical operation of every atom on a chip and also see through every legal trap in patent litigation. In the era of Taiwan's technology industry surging forward in the 1990s, Dr. Chen Xin was an irreplaceable 'pioneer pathfinder' and 'chief gatekeeper' in the field of intellectual property.
When Mr. Stan Shih, with his vision and courage, pioneered a new era of personal computers, Dr. Chen Xin acted like a wise strategist, implementing Acer's intellectual property strategy and using flexible legal tactics to expand the reach of its products and fend off strong competitors. He has worked at industry giants such as Acer, TSMC, Chimei, and ASE, and when faced with attacks from international patent behemoths, he did not passively defend with a shield but wielded the sword of law to strike back precisely. His saying, 'Resistance comes from knowledge and the effective use of knowledge,' is not just a legal maxim, but a profound insight into how Taiwan’s tech industry survives in the gaps of international competition. If Mr. Shih created the technological legend of Made in Taiwan, then Dr. Chen personally forged the legal armor for that legend.
With the humor and sense of mission of an intellectual, he transformed rigid knowledge of science, engineering, and law into ten published works, as exemplified in "Fundamentals of Crystal Law" and "Key Case Interpretations of U.S. Patent Litigation." He did not hoard this wisdom for himself, but spread it through lectures, teaching, and writing, planting seeds of intellectual property knowledge with the precision of science and engineering, the sharpness of law, and the warmth of the humanities. These seeds have taken root in the industry and universities, cultivating talent, and continue to flourish within Taiwan's technology sector.
His eyes, originally used for researching spatial physics, ultimately focused on legal education in Taiwan’s high-tech industry. From his ancestors’ studies in geometry to his own mastery of physics and law, Dr. Chen Xin, through his wisdom and dedication, has written, taught, and passed on experience, perfectly embodying the family tradition of "pursuing truth in science, applying knowledge in the humanities." This contribution, which has greatly benefited Taiwan, is something we should remember forever.
With this article, I pay my deepest respect and remembrance to this cross-disciplinary giant of the era of intellectual property.
